Should You Talk to the Other Driver’s Insurance Adjuster?

If you've recently been in a car accident in North Carolina, chances are the other driver’s insurance company will call you quickly sometimes within 24 hours. They may sound friendly or even concerned about your well-being, but should you actually talk to them?

At Paul Robinson Law, we’re here to protect your rights and guide you through this process. Here’s what you need to know before answering that call.

Why the Adjuster Is Calling You

The other driver’s insurance adjuster works for the insurance company not for you. Their job is to protect the insurer’s bottom line, often by:

  • Getting you to say things that weaken your claim

  • Pressuring you to settle quickly before you understand the full extent of your injuries

  • Recording your statement to use it against you later

You’re Not Required to Talk to Them

In most cases, you are not legally required to speak with the other driver's insurance company. In fact, we advise you not to do so until you’ve spoken with an attorney. What you say especially if recorded can be misinterpreted or taken out of context.

For example:

  • Saying “I’m fine” could be used to argue that you're not injured.

  • Guessing about what happened (“I think I might’ve been going a little fast”) could hurt your case even if it's not true.

What Happens If You Talk to Them Anyway?

If you choose to speak with the adjuster, understand that:

  • They are trained to ask questions that benefit the insurer

  • They may try to get you to accept a low settlement early on

  • Your statement could be used to deny or reduce your claim later

Even polite, honest answers can work against you in North Carolina, which follows contributory negligence laws meaning you could be barred from recovery if you're found even 1% at fault.

What You Should Do Instead

  • Politely decline the call, or tell them you’re seeking legal advice.

  • Call Paul Robinson Law before making any statements or signing any documents.

  • Let us handle communication with the insurance companies so you can focus on recovery not legal strategy.
